The minister, of the (Supreme Federal Court), accepted a statement from the (Attorney General’s Office) and ordered this Thursday (16) the shelving of the request by federal deputy Rui Falcão (PT-SP) for the governor of, (Republicans), to be investigated for obstruction of justice.
At the beginning of last month, Falcão filed a representation against Tarcísio, asking that the ex-president’s ally () be the target of investigation after the discussions carried out with parliamentarians for the vote on amnesty for those convicted on the 8th of January.
In , the PGR stated that the representative of the Workers’ Party does not have the prerogative to request the opening of a criminal investigation, this role being the responsibility of the Public Prosecutor’s Office, which is responsible for deciding whether to offer a complaint or request to archive the investigation or pieces of information.
Furthermore, the Prosecutor’s Office also said that the information contained in Falcão’s representation “does not have minimum information elements, which sufficiently indicate the reality of a criminal offense, justifying the launch of the intended investigation”.
The document signed by Falcão stated that “Tarcísio’s presence in Brasília aimed to mobilize parliamentary support for a broad amnesty, as a toll to make his candidacy viable [à Presidência] with the support of the extreme right who are irresigned to the judgment of their leader”.
“The episode, therefore, goes beyond freedom of expression or political action, as it consists of direct interference in the jurisdiction, trying to weaken the court’s authority”, stated the PT member.
The petition was directed to Moraes, rapporteur of the action regarding an attempted coup d’état. He has not yet commented on the matter.
