The minister of the Federal Supreme Court authorized, in a decision dated October 6th, to carry out investigations at the 13th Federal Court of (PR), in which the then judge worked, within the scope of investigations into
Garcia claims to have been forced to record people illegally at Moro’s request during investigations in December 2004, as part of his plea agreement.
According to the former deputy, the then judge promoted “clandestine investigative measures against authorities holding jurisdiction by prerogative”, including the then governor of Paraná and ministers of the STJ (Superior Court of Justice). Moro denies the accusations.
The former deputy also states that documents currently in the possession of the former Moro court can help corroborate his accusations. In his decision, Toffoli agreed to the examination of the material.
“I believe that the proposed measures should be undertaken by the police authority, with a view to authorizing the on-site examination of related processes, documents, media, objects and the like related to the investigations”, states the minister.
Toffoli also maintained the investigation in , contrary to the senator’s request, who argues that the facts analyzed predate his mandate.
In a statement, Moro’s defense says that it did not have access to the investigation files, “established based on a fanciful report by Tony Garcia”.
According to the senator, there were no irregularities in the process 20 years ago. “The senator has no concerns about the STF’s broad access to the cases in which he served as a judge. These steps will only confirm that Tony Garcia’s reports are lies,” he stated.
