The Chamber of Deputies is expected to vote in the coming days on the urgency of Bill 5,041/2025, which seeks to guarantee free hand luggage on domestic and international flights operated in Brazil.

The proposal attempts to stop the charge that some companies have started to apply on international routes, reigniting the debate about passenger rights.

Nicknamed PL das Bagagens, the text was authored by deputy Da Vitória (PP-ES) and is supported by (Republicanos-PB), who promised to put the issue to a vote.

What does the project say

The text ensures that every passenger can take one hand luggage and one personal item, such as a bag, backpack or briefcase, free of charge, as long as the weight and dimension limits set by Anac (National Civil Aviation Agency) are respected, currently up to 10 kg.

The proposal prohibits airlines from offering fares that exclude or restrict this right. Charges may only occur if the bag exceeds the permitted weight or size.

Anac will be responsible for monitoring compliance with the rules and applying penalties to companies that violate the rules.

The discussion gained strength after international flights, a practice that should also be adopted by Gol.

Azul, in turn, stated that it will not charge for the service. The companies justify the charge by saying that low-cost international companies already apply similar rates in Brazil.

What changes

If the project is approved, all airlines operating in the country will have to guarantee free transport of one hand luggage, both on domestic and international flights.

The text also standardizes the rules and reinforces Anac’s role as a supervisory body, reducing the scope for different practices between companies.

In practice, the PL transforms into federal law a right that is currently only provided for in an Anac resolution, which makes it difficult to change on the initiative of the companies themselves.

Next steps

With the urgency about to be voted on, the project can go directly to the plenary, without going through the thematic committees. If approved by the Chamber, it will go to the Senate before reaching presidential sanction.
