The defense of the former presidential advisor, one of the defendants in the coup plot process in , requested a disciplinary and functional investigation against delegate Fábio Shor, from the Federal Police,
In 2024, Martins spent six months in a penitentiary in the metropolitan region of Curitiba after being accused of traveling to the USA at the end of the government of . Last October 10th
This Monday (20), Shor asked the STF to investigate the incorrect immigration information and indicated that Martins himself could have simulated entry into American territory. For the defense of the former Bolsonaro advisor, the insinuation is absurd and seeks to mask Shor’s negligence and bad faith.
“The police chief tries to justify, retroactively, an unfounded arrest, transforming the investigation into a platform to defend his own reputation”, say lawyers Jeffrey Chiquini and Ricardo Scheiffer Fernandes.
The defenders also claim that they will sue the CGU (Comptroller General of the Union) and the MPF (Federal Public Ministry) against Shor.
Martins’ representatives say that the delegate ignored evidence that the former advisor never left the country at the end of 2022.
“On December 31 [de 2022]Filipe Martins took a domestic flight from Brasília to Paraná. He took up residence in the city of Ponta Grossa, where he lived normally, using his telephone number, receiving bills in his name and using his credit and debit cards conventionally”, they say.
Furthermore, they state that since October 2023 the PF has been monitoring Martins through his telephone and geolocation data, which would make his preventive detention the following year even more unnecessary.
Lawyers also point to the police chief’s attempt to criminalize the work of the press and lawyers, saying that a “digital militia” was responsible for criticizing Martins’ arrest.
“The document [de Shor]under the guise of a technical report, is in fact an attempt to criminalize the law, the press and citizenship, in addition to a confession of incompetence, bad faith and misuse of purpose”, they say.
They add that Martins’ arrest was an attempt to extract a plea bargain from him,
In the coup plot process, Martins is accused of having prepared the draft of the coup that would be carried out by Jair Bolsonaro, which he denies. The trial of its nucleus in the process should take place in December.
