The minister of the (Federal Supreme Court) voted this Tuesday (21) to reopen the investigation against the president of , , for his alleged participation in .
The suggestion was made after Moraes voted for , president of the Instituto Voto Legal, hired by the Liberal Party in 2022 to produce a report against electronic voting machines.
“Once the conviction of Carlos Cesar Rocha was confirmed, [sugiro] that we must extract copies of the decision and the entire body of evidence for submission to PET 12100 so that, under the terms of article 18 of the Code of Criminal Procedure, we can reopen the investigation and analysis of the crimes of criminal organization and attempted abolition of the Democratic Rule of Law in relation to the president of the PL, Valdemar Costa Neto”, said Moraes.
The minister’s suggestion will be analyzed by the other members of the First Panel of the STF. This Tuesday, the collegiate judges the nucleus responsible for the disinformation in the coup plot.
Alexandre de Moraes voted to convict Carlos Cesar Rocha for producing a report that created false suspicions of fraud in part of the ballot boxes used in the 2022 elections.
Based on this report, the Liberal Party filed a representation with the TSE (Superior Electoral Court) asking for the votes of almost half of the ballot boxes to be annulled. The action was rejected by the Electoral Court, and the party was ordered to pay a fine of almost R$23 million for litigation in bad faith.
“According to the Liberal Party, these ballot boxes from before 2020 were rigged. They directed votes and the ballot boxes after 2020 did not. And why is that? Because the ballot boxes before 2020, according to them, would have given more votes to candidate Lula and the others to candidate Bolsonaro,” said Moraes.
The minister said that PL filed the action in bad faith. He argues that the Liberal Party’s action only wanted to annul the votes from the second round of the presidential elections, without involving the first round in the process — when the party elected 99 deputies.
“I really say this with pain in my heart, but this is one of the most bizarre things that the Electoral Court has ever received”, added Moraes.
Valdemar Costa Neto was for participating in the attempted coup d’état. According to the corporation, the party leader played a crucial role in the coup plans.
The party leader was arrested during a Federal Police operation to investigate the coup plot for illegal possession of a weapon. During the searches, the PF also found a nugget of gold with the politician.
The (Attorney General’s Office), however, is on the list of those denounced for the coup plot.
In Moraes’ opinion, it makes no sense for the Supreme Court to condemn only the technician responsible for producing the fraudulent report if the person responsible for using the document to favor Bolsonaro was Valdemar.
If Moraes’ suggestion has a majority, the investigation will be reopened against the PL president only for crimes linked to the attempt to abolish the Democratic Rule of Law and the criminal organization.
