The First Class of resumes this Tuesday (21) the trial of the defendants of the andwhich occurred during the government of former president Jair Bolsonaro. The trial began last week, when the defended the conviction of the seven defendants who are part of the group, which is accused of organizing disinformation actions to spread false news about the electoral process and virtual attacks on institutions and authorities, in 2022.
In the same session, the defendants’ defense asked for acquittal and denied the defendants’ involvement in actions to spread disinformation. The following are part of this group: Ailton Gonçalves Moraes Barros (Army reserve major), Ângelo Martins Denicoli (Army reserve major), Giancarlo Gomes Rodrigues (Army warrant officer), Guilherme Marques de Almeida (Army lieutenant colonel), Reginaldo Vieira de Abreu (Army colonel), Marcelo Araújo Bormevet (federal police officer) and Carlos Cesar Moretzsohn Rocha (president of Instituto Voto Legal).
They are responsible for the crimes of armed criminal organization, attempted violent abolition of the Democratic Rule of Law, coup d’état, qualified damage through violence and serious threat and deterioration of listed property.
Voting
The session will open with the vote of Minister Alexandre de Moraes, rapporteur of the Nucleus 4 criminal action. The minister will decide whether to convict or acquit the accused. In case of conviction, Moraes will also announce the sentence for the defendants. Then, the other members of the First Panel begin to vote. Minister Cristiano Zanin will be the first to speak after the rapporteur. Later, ministers Luiz Fux, Cármen Lúcia and Flávio Dino, president of the collegiate, will vote. Defendants who are convicted by the STF will not be automatically arrested. The defenses will be able to appeal the possible conviction.
Other cores
To date, only Nucleus 1, formed by former president Jair Bolsonaro and seven other defendants, has been convicted. In addition to Core 4, Cores 2 and 3 will be judged later this year. The trial of Core 3 is scheduled for November 11th. Group 2 will be judged in December. Nucleus 5 is formed by businessman Paulo Figueiredo, grandson of former president João Figueiredo. He lives in the United States and did not present a defense in the process. There is still no date set for the trial.
