A second class of TRT-2 (Regional Labor Court of the 2nd Region), unanimously denied the appeal politician and businessman Pablo Marçal against the sentence of almost R$2 million for the work accident which led to the death of Celso Guimarães Silva, aged 49, during service provision for the company Marçal Participações LTDA, published exclusively by CNN.
The trial took place virtually in October this year, after the influencer questioned the validity of the victim’s family’s arguments and was published this Tuesday (21). The judge and rapporteur of the case Cândida Alves Leão understood that the testimony of one of the employees is valid and that, despite working together sporadically, an intimate friendship is not understood, which would invalidate the testimony — Marçal’s defense argument.
The Court also understood that the appeal was delaying, that is, used to postpone the progress of the process, and imposed a fine on the company. With the fine and compensation for moral and material damages — and monetary corrections — the Marçal Participações must pay around R$2.4 million reais to lawyers and family. Celso left behind a wife and three children.
The conviction can be appealed to the Superior Labor Court (TST). THE CNN contacted Pablo Marçal’s advisors and did not receive a response at the time of publication of this report. The space remains open.
The work accident
The professional specialized in electrical installation in audiovisual production studios was working on dismantling a cinema in Alphaville, an upscale neighborhood in the municipalities of Barueri (SP) and Santana de Parnaíba (SP), when he suffered an accident in June 2023.
The victim was rescued by the Mobile Emergency Care Service (Samu) and taken to the Barueri Municipal Hospital — and did not survive the injuries.
An expert report from the Civil Police pointed out that the work environment was unsafe, due to the exposed electrical wiring e without insulation and by absence or lack of structure for the correct use of safety equipment.
The unsafe working conditions were also confirmed by the victim’s report via video at the hospital and by the testimony of employees who witnessed the accident, according to the Court.
The process, which is being carried out under judicial secrecy, was dismissed in the first instance, at the 5th Labor Court in Barueri, and the second class of TRT2 was reformed, after the family lawyer specializing in compensation, Eduardo Barbosa, appealed to the Court.
