The judge also noted that the type of appeal presented by Deck Produções is intended exclusively for those contexts and that it could not be used by the record company as a way of reversing the decision that terminated the abusive contract with Larissa Manoela.
The denial of the appeal opens space for what appears to be a close and decisive end to the action initiated by global.
Remember the controversy
The record label Deck Produções maintained an exclusive relationship with Larissa Manoela. The document was signed by the actress’s parents in 2012, when she was just 11 years old.
Global managed, however, to terminate the contract in April this year. Based on the decision of judge Mário Cunha Olinto Filho, of the 2nd Civil Court of the Rio de Janeiro Court of Justice (TJRJ), the company will have to hand over to the actress the logins and passwords for the YouTube and Spotify accounts and channels. Content produced by the artist was posted on the profiles.
In the case file, the defendant justified that breaking the contract would only be possible with the authorization of Gilberto Elias and Silvana Taques, but the magistrate countered, considering that “the author has already reached the age of majority, being fully capable of carrying out acts of civil life, including contracting and terminating contracts”.
Also in accordance with Olinto Filho’s determination, the record company will no longer be able to display or broadcast the materials produced by Larissa during the duration of the professional relationship. In addition, the judge ordered the payment of a fine of R$5,000 and R$15,000 in case of non-compliance.
