STF condemns seven defendants from the ‘disinformation nucleus’ of the coup plot

The First Class of concluded this Tuesday (21) another phase of the trial of the coup plot, condemning the seven defendants who were part of the so-called “disinformation nucleus” (nucleus 4). According to the ministers, it was proven that the group created and disseminated false news about electronic voting machines and the Judiciary with the aim of generating political instability and justifying authoritarian measures, in addition to acting in an attempt to abolish the Democratic Rule of Law after the 2022 elections.

The Panel, composed of ministers Alexandre de Moraes (rapporteur), Cristiano Zanin, Cármen Lúcia and Flávio Dino, with Luiz Fux being the only one to disagree so far, also highlighted the misuse of the Brazilian Intelligence Agency (Abin) to produce fake news and illegally monitor authorities.

Convicts of “Núcleo 4”:

  • Ailton Gonçalves Moraes Barros (retired Army captain): 13 years and 6 months sentence + fine of 120 minimum wages.
  • Ângelo Martins Denicoli (Army reserve major): 17 years sentence + fine of 120 minimum wages.
  • Carlos César Moretzsohn Rocha (former president of Instituto Voto Legal): 7 years and 6 months in prison + fine of 40 minimum wages.
  • Giancarlo Gomes Rodrigues (Army warrant officer and former Abin employee): 14 years sentence + fine of 120 minimum wages.
  • Guilherme Marques Almeida (Army lieutenant colonel): 13 years and 6 months sentence + fine of 120 minimum wages.
  • Marcelo Araújo Bormevet (federal police officer and former Abin employee): 14 years and 6 months sentence + fine of 120 minimum wages.
  • Reginaldo Vieira de Abreu (Army colonel): 15 years and 6 months sentence + fine of 120 minimum wages.

Previous Convictions of “Núcleo 1”:

This step adds to the previous convictions of “core 1”, which includes prominent figures. Former president Jair Bolsonaro was sentenced to 27 years and 3 months in prison for commanding an attempted coup d’état and heading a criminal organization. Seven other defendants were also sentenced in the same group:

  • Mauro Cid (lieutenant colonel and former adjutant): 2 years in open prison.
  • Walter Braga Netto (general and former Minister of Defense and Civil House): 26 years in prison in an initial closed regime + 100 days fine.
  • Alexandre Ramagem (federal deputy and former director of Abin): 16 years, 1 month and 15 days in closed prison + 50 days fine and loss of mandate.
  • Almir Garnier (admiral and former Navy commander): 24 years in closed prison + 100 days fine.
  • Anderson Torres (former Minister of Justice and former Secretary of Public Security of the DF): 24 years in closed prison + 100 days fine.
  • Augusto Heleno (general and former GSI minister): 21 years in closed prison + 84 days fine.
  • Paulo Sérgio Nogueira (general and former Minister of Defense): 19 years in closed prison + 84 days fine.

The next group to be tried is “nucleus 3”, made up of nine military personnel and a Federal Police agent, accused of attacking the electoral system and planning an institutional rupture, including an alleged plan to assassinate authorities. The trial is scheduled for November 11, 12, 18 and 19.
“Nucleus 2”, with six defendants accused of organizing actions to support Jair Bolsonaro’s illegitimate attempt to remain in power, will be judged on the 9th, 10th, 16th and 17th of December.
