A preliminary decision by the National Council of Justice () could generate savings of almost R$805 million for the City Council this year.
Minister Mauro Campbell understood that the rules of constitutional amendment number 136, promulgated in September, must now be applied.
Before this amendment, the city allocated 5% of Net Current Revenue (RCL) to the payment of court orders, the maximum limit established by the CNJ, which represents around R$5 billion per year.
With the new rules, this percentage was 2.5% of the RCL. The municipality’s total debt with court orders is approximately R$42 billion.
The mayor’s management () states that, with the decision, published on Wednesday night (22), it intends to allocate the extra amount to areas such as health, education and infrastructure.
“This decision is important for the entire Brazilian population. PEC 66 brings a rebalance to the municipalities, adjusts the table and schedule of payment of court orders and, with this, increases the power of investment in public policies of the municipalities”, stated the mayor.
Marques, national inspector of Justice, also determined that the TJ should not apply any sanction, be it freezing of assets or suspension of certificates, until the final judgment of the case. The process, however, needs to be submitted to the CNJ plenary.
