Government wants to infiltrate agents into criminal factions

The Anti-Faction bill, from the Ministry of Justice, allows the use of fictitious companies and disguised whistleblowers to advance investigations

The Minister of Justice presented this Wednesday (October 23, 2025) the draft law that creates the PL Antifactionthe federal government’s new public security package. The proposal allows agents and collaborators to infiltrate criminal factions, with judicial authorization and false identities.

The text will still be analyzed by the Civil House before being sent to Congress. The project will run in parallel with the PEC of Public Security –one of the priorities and promises of the management of (PT).

Infiltration and fictitious companies

The main innovation of the Antifaction PL is the regulation of police infiltration into criminal organizations, a practice that is carried out today without a clear legal framework. Agents may act with fictitious documents, such as birth certificates and identity cards issued by court order.

The plan also establishes the creation of fictitious companies for infiltration operations. “These companies will have CNPJ, employees and meetings, all in a controlled manner”disse Lewandowski.

Companies will pay taxes normally and will be able to sell products such as cell phones, gas cylinders or medicines to investigate illicit enrichment schemes such as money laundering.

According to the ministry, similar mechanisms already exist in countries such as the United Kingdom and Germany.

New plea bargain

The bill also changes the rules for award-winning collaboration. Today, the whistleblower needs to end any link with illicit activities. The new text allows him to remain undercover within the criminal organization to assist investigations.

“It’s a new form of collaboration. The whistleblower not only reveals facts or indicates evidence, but can continue to act undercover, helping to obtain elements that prove the crimes”, said the minister. According to Lewandowski, the benefits granted to the employee will be evaluated by the Public Prosecutor’s Office and the judge at the time of sentencing.

The minister justified that the measure does not constitute ideological falsehood, as “A crime is only what the law does not authorize”.

Security package

The Antifaction PL was presented . The minister stated that the initiatives were discussed with President Lula, who “determined to spare no effort in combating organized crime”.

Lewandowski classified the text as “a contribution to the legislative debate” and stated that the processing can be accelerated, “if there is good will” in Congress. The president of the Chamber, Hugo Motta (Republicanos-PB), has expressed interest in voting on public security projects and government agendas.

The minister admitted that the text could be split during the discussion in Congress, depending on the House’s electoral calendar in 2026. Regarding the Public Security PEC, the minister clarified that the procedures will be separate.

Tougher penalties and national faction bank

The project changes the Criminal Execution Law to the allow emergency transfers of prisoners linked to factions and modifies the Code of Criminal Procedure to speed up the confiscation of assets and valuables from defendants.

The crime of a qualified criminal organization is now considered heinous. The text also establishes more severe penalties for burning and reception. .

The government also plans to create a national database of faction members, with information shared between security forces and the use of artificial intelligence to cross-reference data.

Lewandowski ruled out the creation of an anti-faction agency due to lack of resources and defended flexibility in operations.
