Minister Alexandre de Moraes, of the Federal Supreme Court (STF), denied this Wednesday (22) the request from the Federal Public Defender’s Office (DPU) to suspend the complaint against federal deputy Eduardo Bolsonaro (PL-SP) until he is officially notified in the United States.
In the order, Moraes stated that the parliamentarian “is creating difficulties in being notified” and highlighted that he maintains his domicile and functional office in Brasília, which makes the use of a letter rogatory, an instrument of international judicial cooperation, unnecessary.
“There is no doubt that the accused, even though he maintains his domicile in national territory, is creating difficulties in being notified”, wrote the minister.

Eduardo Bolsonaro is accused by the Attorney General’s Office (PGR) of . The parliamentarian did not present a prior defense within the stipulated period after being denounced.
Given the absence of a response from the deputy, he ordered that the preliminary defense be presented within 15 days. The Public Defender’s Office, however, requested the suspension of the process until the parliamentarian was formally notified in the USA, which was rejected.
The minister cited public statements by Eduardo Bolsonaro to support the decision. According to Moraes, the deputy’s statements confirm that he is “temporarily” out of the country and that his absence may be associated with the attempt to avoid possible judicial liability.

“Eduardo Nantes Bolsonaro’s demonstrations indicate that the accused, on a temporary basis, is outside the national territory, exactly as stated in the complaint, to reiterate criminal practice and evade possible judicial liability”, wrote Moraes.
With the decision, the DPU must present the deputy’s preliminary defense by the beginning of November. The process is part of the investigation into disinformation actions and international pressure against the Supreme Court, which also involves other allies of former president Jair Bolsonaro (PL).
