Chamber rejected appeal that forced text to be voted on in plenary; proposal requires immediate analysis of individual decisions
PL (bill) 3,640 of 2023, which establishes limits for monocratic decisions in the STF (Supreme Federal Court) and restricts the actions of smaller parties, goes directly to the Senate. By 344 votes against and 95 in favor, the federal deputies blocked, This Wednesday (22.Oct.2025), the appeal presented by the Novo party requesting a vote on the text in the Chamber plenary.
The project, authored by the president of the Republicans, deputy (SP), was approved by the CCJ (Constitution and Justice Commission) of the Chamber on September 30th, following a vote by the rapporteur (Cidadania-SP). Rules for monocratic decisions
The proposal establishes new criteria for individual decisions by Supreme Court ministers and determines deadlines for them to be submitted to the Court’s plenary. According to the appeal presented by Novo, due to the “relevance and impact of matter” it would be necessary to analyze the text in the plenary, “sovereign instance” of the House. One of the central points of the project is the requirement that monocratic decisions of the STF be analyzed by the collegiate “immediately” in the following session. The text also determines that every individual decision must be justified, based on the already consolidated position of the plenary and automatically included in the STF’s judgment agenda.
The most controversial aspect of the proposal is the limitation for political parties to invoke the STF. The text restricts the presentation of constitutionality control actions only to subtitles that reach the barrier clause.
Processing
In the Senate, the text will undergo further processing. If it is approved by the senators without changes, it will go to presidential sanction. If there are changes, it will be returned to the Chamber for further analysis. There is still no forecast of when the senators will analyze the proposal.
