Tunnel addendum forces SP to mention federal participation – 10/22/2025 – Panel

An addendum to the contract signed between the Lula governments and for the construction of the tunnel – obliges the state management to mention the federal government’s participation on signs and advertising material for the work.

The addendum to the contract, signed on October 14th, complements the agreement signed in February this year that contains the parties’ obligations. The document is signed by the Ministry of Ports and Airports, the Port Authority of Santos and the government of .

The amendment meets a series of recommendations from the Federal Audit Court (TCU), to fill gaps regarding the rights and duties of each party.

One of the clauses deals with the obligation of the delegatee (government of São Paulo) to “post in a visible location a work sign prepared in accordance with the Federal Government Brand Use Manual – Works, keeping it in good condition throughout the period of execution of the works, as well as the inclusion of the Federal Government brand in any and all institutional advertising that is related to the object of this”.

Although there is no mention of the federal government’s obligations to do the same in relation to the state government, there is an understanding that there would be this reciprocity, according to the Panel found.

In a note, the Tarcísio government stated that the amendment to the agreement signed with the Ministry of Ports and Airports updates administrative clauses related to the execution of the Santos–Guarujá Tunnel.

“The agreement will be observed, in accordance with the applicable standards and the schedule for the start of works”, he indicated. “The Government of São Paulo maintains technical and permanent dialogue with the Union and the Santos Port Authority to guarantee efficient, transparent execution and aligned with the public interest.”

To try to pacify the topic, the amendment recalls in its preamble “the common interest of the participants in the development of the project”.

Other points covered in the amendment refer to the transfer of resources from the Union to the government of São Paulo for the work. A clause says that the federal government must guarantee the transfer within 60 days after signing the contract for the work, which must be completed by 2031.
