The minister of the STF (Supreme Federal Court), Alexandre de Moraes, determined that the defense of Filipe Martins, former special advisor for International Affairs to the Presidency of the Republic in the government of Jair Bolsonaro (PL), explains the failure to comply with the precautionary measures imposed on the defendant.
According to a report from the Electronic Monitoring Division of the Paraná Penal Police, used to support Moraes’ request, Martins’ electronic ankle bracelet was turned off for around an hour on October 23.
He is identified as a member of “nucleus 2” of the coup plot that attempted to abolish the Democratic Rule of Law.
“No GPS signal (uMov) on 10/23/2025, from 17:50:43 until 18:53:22, with a total duration of 1h02:39”, points out the Criminal Police report.
In view of the incident, Moraes ordered the defense to present justification within five days. If the deadline is not met or the explanation is considered unsatisfactory, the minister may order Martins’ preventive detention.
On October 9, the minister, understanding that they acted in an “unusual” way and with a “clear procrastinatory nature”, by failing to present the final arguments within the deadline, even after having been notified.
According to the minister, the conduct constituted bad faith litigation and an attempt to delay the progress of the criminal action investigating the attempted coup d’état. Martins is represented by lawyer Jeffrey Chiquini.
Subsequently, Moraes reconsidered the decision and granted an additional period of 24 hours for the defenses of Filipe Garcia Martins Pereira and Marcelo Costa to present their final arguments, which had not been filed within the legal deadline.
Filipe Martins is part of “nucleus 2” of the coup plot and has his trial at the Federal Supreme Court scheduled for the 9th, 10th, 16th and 17th of December.
