Senator Eduardo Braga (MDB-AM) reduced the percentage of the administrative fine applied by the National Electric Energy Agency (Aneel) from 4% to 3%.

The change is contained in a report presented this Wednesday, 29th, to provisional measure 1,304/2025, with changes in the electricity sector.

With the change, the text now determines that the regulatory agency may “set the administrative fines to be imposed on concessionaires, permit holders and authorized persons of electrical energy installations and services, subject to the limit, per infraction, of 3% of revenue, or the estimated value of the energy produced and consumed in cases of self-production, independent production and authorized consumer units”.

The calculation will take into account the “last 12 months prior to the issuance of the infraction notice or estimated for a period of 12 months if the violator is not in operation or has been operating for a period of less than 12 months”.

The MP needs to be voted on by the plenary sessions of the Chamber and Senate by November 7th. Otherwise, it will lose its validity.
