This Wednesday (29) he sent a statement to the minister, from ), about the mega police operation carried out in the Alemão and Penha complexes, in Rio de Janeiro, which left 119 people dead. The response was requested by Moraes after the National Human Rights Council asked the Supreme Court to verify possible non-compliance with the measures of the ADPF das Favelas, which imposes limits on police actions in the state.
According to the PGR, the National Council of the Public Ministry (CNMP) has already created a specific working group to monitor compliance with the determinations of the ADPF for Favelas and requested clarifications from the government of Rio de Janeiro. The information sent by the state will be evaluated before any new measures are taken.
The ADPF das Favelas was approved by the STF in 2020 and established a series of restrictions and protocols for police operations in communities, with the aim of reducing lethality. Among the measures were limiting the use of helicopters, mandatory cameras on uniforms and vehicles and prior communication of actions to the Court. In April this year, part of these requirements was relaxed, once again allowing the use of aircraft and removing the obligation to provide prior notice.
With the retirement of Minister Luís Roberto Barroso, the process was left without a rapporteur and, by regulation, was temporarily passed to Minister Alexandre de Moraes, who was the case’s reviewer. Moraes asked the PGR for a statement to clarify whether the mega-operation respected the rules established by the Supreme Court.
During a press conference at Palácio da Alvorada, the Minister of Justice, Ricardo Lewandowski, and the director general of the Federal Police, Andrei Rodrigues, stated that the PF already operates in Rio in investigations linked to organized crime and that it follows ADPF guidelines. “We are facing crime with intelligence and strategy, decapitalizing the economic power of the factions,” said Rodrigues.
In the STF plenary, Minister Flávio Dino also commented on the case, stating that it is necessary to avoid “easy speeches” in times of crisis and remember that there are good and bad professionals in all areas, including public security. The Supreme Court is now awaiting the return of information from the Rio de Janeiro government to decide whether there will be new measures within the scope of the ADPF das Favelas.
