STF minister argues that the former minister of the Civil House should remain in prison to serve a 26-year sentence for attempted coup
Minister Alexandre de Moraes, of the STF (Supreme Federal Court), decided this Monday (3.Nov.2025) to maintain the arrest of the former Minister of the Civil House, General.

The since December 14, 2024 on charges of obstructing the investigation into the attempted coup d’état in the country to prevent the inauguration of the president (PT).
In the decision, Moraes highlighted that the general was sentenced to 26 years and 6 months in prison in the criminal action for the coup plot and the solidarity payment of R$30 million for the damage caused in the coup acts of January 8, 2023. Considering this, he stated that there was a risk of the general fleeing.
“The end of the trial on the merits of this criminal action and the well-founded fear of the defendant escaping, as has repeatedly occurred in similar situations in the convictions referring to January 8, 2023, authorize the maintenance of preventive detention to effectively guarantee the application of criminal law”stated the minister.
During the investigations, the Federal Police identified that the general, accused of being one of the main organizers of the coup plan, tried to obtain confidential data from Mauro Cid, Bolsonaro’s former aide-de-camp.
After the arrest, the defense denied that Braga Netto had obstructed the investigations.
