The country’s main audiovisual producers ask in a letter addressed to party leaders for the approval of bill 8889/2017, which regulates streaming platforms no. The proposal is on the agenda this Tuesday (4). The letter is signed by 96 production companies, including CineFilmes, Paris Produções, O2 and Paranoid, and expresses support for the opinion of the rapporteur, deputy Dr. Luizinho (PP-RJ), who presented a replacement for the original project.
According to the companies, the text “represents a pragmatic and robust advance in the regulation of Audiovisual Content on Demand”, a streaming content distribution model.
According to the producers, the proposal is the result of a “broad negotiation process”, which “consolidates crucial points for the development and sustainability of Brazilian audiovisual”. “Not approving this text now means losing at least another two to three years without the law, perpetuating the current situation of imbalance and playing into the hands of those who prefer not to regulate the market”, argues the document.
Companies also reinforce the economic and cultural importance of the sector. “Our companies have hundreds of audiovisual professionals permanently hired and, with each production, thousands are involved. Our productions are those that the Brazilian population knows and likes. Supporting the current text is not an ideological issue. It is supporting the increase in independent audiovisual production in Brazil.”
Dr. Luizinho’s text establishes that streaming services have a 10% quota of titles from Brazilian producers and that providers are included as contributors to the Contribution for the Development of the National Cinematographic Industry (Condecine). The contribution will be charged as a progressive annual tax on revenue, with a maximum rate of 4% for the largest video on demand platforms and 2% for audiovisual content sharing services.
Revenues must be allocated to specific applications, including the production of independent Brazilian content (especially those aimed at children and adolescents) and support for research and technological innovation in the audiovisual ecosystem. Furthermore, a minimum of 30% must be allocated to Brazilian producers in the North, Northeast and Central-West regions.
