Chamber approves increase in paternity leave

A unanimously approved this Tuesday (4) the extension of paternity leave from 5 to 20 days. The approved project foresees that the law will come into force on January 1, 2027, however, for validation, the text will still undergo new analysis by the Federal Senate, which, if approved, will proceed to presidential sanction. The measure applies to employees who are parents, adopt or obtain legal custody of a child or teenager, and will be implemented in three stages. According to the text, paternity leave will be:

  • 10 days, from the first to the second year of the law’s validity;
  • 15 days, from the second to the third year of the law’s validity;
  • 20 days from the fourth year of force of the law.

The proposal to extend maternity leave is from rapporteur Pedro Campos (PSB-PE) and the initial text spoke of an increase of up to 30 days, which would be implemented progressively over five years, starting with 10 days and increasing every five days until reaching 30 days from the fifth year onwards. However, there was a change so that there was agreement with the opposition.

The financial impact of the expansion estimated by the rapporteur is R$5 billion per year, and the leave can be divided into two periods, except in cases of death of the mother, in addition to the project, prohibiting the employee from being dismissed without just cause within a period of up to one month after the end of paternity leave. During the period of absence, beneficiaries will be entitled to full salary, subject to the ceiling established by Social Security.
