Cade investigates delivery market

Monitoring takes place in the cities of Goiânia (GO), Rio de Janeiro (RJ), Santos (SP), São Paulo (SP) and São Vicente (SP)

The Administrative Council for Economic Defense (Cade) has been monitoring the delivery market in several Brazilian cities since Saturday (Nov 1, 2025). The body is responsible for ensuring fair competition in the country.

According to the Council’s request, monitoring of activities in online food retail will be carried out in the cities of Goiânia, Rio de Janeiro, Santos, São Paulo and São Vicente. Read (PDF- 171 KB),

In the document, the entity requests the Department of Economic Studies (DEE) to prepare an economic study or opinion to guide the monitoring of activities at the sites.

The movement takes place during the intensification of the so-called “app war”, with companies such as iFood, 99Food (controlled by the Chinese DiDi) and Keeta (from the Chinese Meituan) competing for market share.

On February 8, 2023, iFood and Cade signed a (TCC) Cessation Commitment Term that establishes criteria and limits the practice of exclusivity in contracts with restaurants.

  • The term establishes the following parameters:
  • maximum duration of two years for contracts;
  • One-year quarantine without exclusivity;
  • Prohibition of signing exclusive contracts with brands that have 30 or more active establishments

The term limits the sales volume linked to exclusivity to 25% of the platform’s total and, in municipalities with more than 500 thousand inhabitants, to 8% of restaurants.
