The minister Flavio Dinofrom the STF (Supreme Federal Court), accompanied rapporteur Alexandre de Moraes and voted this Friday (7) to reject the appeal presented by the former president’s defense Jair Bolsonaro (PL) against conviction for attempted coup d’état.
The trial of the appeals of the convicts from nucleus 1 began this Friday in a virtual plenary session. Ministers have until next Friday (14) to register the votes.
Dino continued to consider that all of the lawyers’ arguments had already been discussed by the First Panel, whether in the trial or in the preliminary analysis.
According to Moraes, without actually presenting situations of omissions and contradictions.
The former president’s defense filed a motion for clarification on the last day of the deadline before the case became final, on October 27th. In the appeal, the lawyers allege “injustices”, “errors” and “mistakes” in the trial.
For now, Dino also dismissed the appeals presented by the defenses of Alexandre Ramagem, Almir Garnier and Walter Souza Braga Netto.
The only convict from group 1 who did not file an appeal was Lieutenant Colonel Mauro Cid. His case became final and Cid has already started serving his sentence since last Monday (3). He was sentenced to two years in open prison.
The First Panel of the STF is currently made up of four ministers: Moraes, Cármen Lúcia, Flávio Dino (president of the collegiate) and Cristiano Zanin. In this case, just three votes are enough for there to be a majority to deny or accept the appeals.
