Filipe Martins challenges PF delegate about leaving Brazil

Defense of former government advisor Jair Bolsonaro (PL) claims that Fábio Shor tries to justify “illegal and abusive” preventive detention

Filipe Martins, former international advisor for (PL)contested the about his possible departure from Brazil in 2022. The statement was sent on Monday (3.Nov.2025) to Minister Alexandre de Moraes.

Martins is a defendant in one of the actions investigating the coup plot in the (Supreme Federal Court). The defense claims that the police chief used the investigation as a “instrument of personal defense in the face of investigative errors already exposed internationally”. Eis and (PDF – 40MB).

Lawyers for Bolsonaro’s former advisor argue that the police chief is trying to rewrite events to justify the detention that they consider undue. According to the defense, the letter sent by Shor “it is not a technical report, but an attempt to rewrite history to justify the illegal and abusive arrest of an innocent person”.

Martins was preventively arrested in February 2024, on charges of being on the run, although he was promptly found in Paraná. One of the accusations was that he could flee Brazil because of an alleged trip to the United States together with the former president on December 30, 2022.

The former advisor was in August 2024 and, since then, he has been complying with precautionary measures, such as the use of an electronic ankle bracelet and the obligation to present himself weekly to the Paraná Court. He is also prohibited from using social networks and communicating with other people under investigation.

On October 10, 2025, Martins achieved a victory after a that records showing his supposed entry into Florida at the end of 2022 were fraudulent. Moraes 5 days for the Federal Police to respond to whether Bolsonaro’s former advisor had entered the United States at the end of that year.

After the CBP note, Shor on October 20, 2025, stating that the insertion of false data into the immigration system may have been a strategy by “criminal organization” to hinder investigations conducted by the corporation. The PF further states that “the methodology observed bears similarity to the actions of the ‘digital militia’”investigated by the Federal Supreme Court.

The new manifestation of Martins’ defense includes the CBP note and an audit of the North American immigration system attesting that Martins never entered on the date alleged by the PF. Notary records of all pages of the former advisor’s 2 passports (diplomatic and common) were also gathered, drawn up at a notary’s office, which attest to the non-existence of any record of his international exit or entry on December 30, 2022.

The origin of the alleged fraudulent records and those responsible for tampering with migration data remain unknown. Martins’ defense disputes the allegation that the former advisor misled American authorities.

Lawyers classify this hypothesis as a “delusional and legally impossible fantasy” . They declared that it was a “attempt to reverse the logic of the investigation, by suggesting that Filipe Martins had ‘misled’ the authorities, staging a non-existent trip to ‘demoralize the PF’”.

The defense criticizes the delegate’s attitude towards people who published the former advisor’s version on social media. According to his lawyers, Shor proposes a “unprecedented and authoritarian proposal to open a new investigation to investigate lawyers, journalists, influencers and citizens who publicly questioned the conduct of the delegate, in flagrant violation of freedom of expression and the prerogatives of the legal profession”.

The defense requested that the information gathered be sent to the PF internal affairs department to investigate the conduct of delegate Fábio Shor in the case. Filipe Martins responds to the STF for participating in the preparation of the “coup minute”, an accusation that he refutes.

According to the complaint from the PGR (Attorney General’s Office), he was responsible for editing the draft and presenting his “legal foundations” to the top brass of the Armed Forces in a meeting on December 7, 2022.
