Former first lady of Peru asks STF to block extradition

The former first lady of Peru, Nadine Heredia, asked the STF (Federal Supreme Court) to suspend any extradition request against her, after being convicted of money laundering by the Peruvian courts.

Heredia has been in Brazil since April this year, when he received diplomatic asylum by the Brazilian government. The request was filed last Tuesday (4). To date, there is no record of extradition requests from the Supreme Court against Heredia, as found by the CNN Brazil.

According to the defense, the evidence used for the conviction in Peruvian justice was obtained from systems Drousys e MyWebDayused by Odebrecht and considered illicit by the Supreme Court.

At the STF, the evidence linked to these systems was considered useless for different legal reasons, including suspicions of illegal acquisition and failures in the chain of custody.

Already in Peruvian justice, allegedly received illicitly to finance electoral campaigns.

In the request to the Supreme Court, the former first lady’s defense requests that the effects of Minister Dias Toffoli’s decision be extended, which annulled the evidence that supported the criminal action against the former president of Peru, Ollanta Humala, husband of Nadine Heredia.

The former first lady’s lawyers point out that the Peruvian court issued an arrest warrant against her and that, currently in Brazilian territory, she is awaiting the analysis of a request for asylum, “due to the serious violation of her human rights when she was convicted in a criminal case based on absolutely zero evidence”.

“Thus, any request for international cooperation to extradite the Petitioner, transfer her criminal execution to Brazil, or serve an arrest warrant will inevitably violate the authority of the decisions handed down in Complaints numbers 61.387/DF and 43.007/DF”, says the defense.

“In this case, authorizing the carrying out of the cooperative act will be equivalent to cooperating with the continuation of a criminal proceeding based on illicit evidence, because it is indisputably disreputable, as already recognized by this Federal Supreme Court”, he adds.
