Moraes votes to make former advisor Tagliaferro a defendant for leaking messages

Minister Alexandre de Moraes, of the Federal Supreme Court (STF), voted this Friday (7) for Eduardo Tagliaferro, former advisor to the Superior Electoral Court (TSE), to be formally charged with alleged acts against the legitimacy of the electoral process and for obstructing investigations related to undemocratic acts.

The trial takes place in the First Panel of the STF, in a virtual environment, with a deadline for completion of the 14th.

The Attorney General’s Office (PGR) denounced Tagliaferro for several crimes, including violation of functional secrecy, coercion during the process, obstruction of an investigation involving a criminal organization and attempted violent abolition of the Democratic Rule of Law.

According to the PGR, he would have leaked confidential information to the press and disclosed confidential dialogues held with employees of the STF and TSE, while acting as chief advisor in the TSE’s Special Advisory for Combating Disinformation.

Tagliaferro’s defense claims that the complaint is inept because it does not identify the criminal organization and does not describe concrete conduct that poses a serious threat in the crime of coercion. Tagliaferro is currently in Italy, and Brazil has already started the extradition process so that he can face charges in the country.

The PGR highlights that the former advisor acted in alignment with a criminal organization that disseminates false news against the electronic voting system and Brazilian judicial institutions.

Furthermore, the complaint points out that he sought to prevent the free exercise of Judiciary Power through fundraising campaigns with the aim of revealing new confidential information.

The Federal Public Ministry (MPF) reinforces that the evidence collected indicates that Tagliaferro acted to favor personal interests and those of groups opposed to democracy, including with public support from Bolsonarists on social media.

Leaving the country, according to the PGR, is part of a strategy to hinder investigations and increase attacks against Brazilian authorities responsible for ongoing legal proceedings.
