Indigenous people from AM sue public agencies for environmental damage – 11/08/2025 – Panel

Protocoled by the Tratarim Morogitá Indigenous People’s Association (Apitem), the action requires urgent measures to contain deforestation and remove invaders from the territory.

The action is unprecedented in that it treats this as a structural violation of rights and diffuse climate damage.

“The aim is, centrally, to confront deforestation and environmental degradation that affect the territory, ensuring the protection of the environment, the guarantee of climate justice and the effectiveness of the constitutional rights of the Teremim people”, says the action.

According to the association, the demand is not only for immediate repressive measures against the invaders, but also “the formulation and execution of a comprehensive territorial protection plan, with mechanisms for inspection, security and prevention of new environmental, climate and land crimes”.

The action is based on data from Ipam (Amazon Environmental Research Institute) and Inpe (National Institute for Space Research), which demonstrate that the loss of the forest has already resulted in the emission of more than 21 thousand tons of CO₂, which threatens the teremim’s way of life and the regional climate balance.

According to indigenous lawyer Mauricio Terena, who signed the action, “defending the Teremrim territory is also defending the climate balance that sustains life in cities.”

The Teremrim people have around 770 people, who live in 12 villages on indigenous land. “The people have been forced to live with external economic and social pressures, often resulting from illicit activities, such as logging, illegal mining, land grabbing and the advancement of the agricultural frontier”, says the action.

The legal document calls for the presentation by public bodies within 45 days of a plan for the deintrusion of indigenous land, in addition to compensation for environmental damage to the termins.
