Commission approves high-caliber weapons for private security guards

The Public Security Committee of the Chamber of Deputies approved a bill that authorizes the use of restricted caliber weapons by private security professionals during the exercise of their duties. The measure changes the .

Currently, legislation allows security guards and companies in the sector to only use common caliber weapons. The use of high-caliber weapons is only authorized in exceptional situations, such as armed escort and transportation of valuables, with specific authorization from the Army.

The approved text transforms this exception into a possibility described in law. According to the proposal, the use of restricted caliber weapons will be permitted in accordance with Federal Police regulations and authorization by the Brazilian Army Command, responsible for controlling military products and weapons.

The authorization will only apply to services considered high risk, such as armed escort, transportation of valuables, security of financial institutions, protection of people, sensitive installations and critical infrastructure, including ports, refineries, plants and energy centers.

The one in the commission is the substitute from the rapporteur, deputy (PL-SP), to bill 3,075 of 2025, authored by the deputy (PP-SP). The rapporteur maintained the central content of the original proposal, but transferred the authority to authorize the use of high-caliber weapons from the Federal Police to the Brazilian Army.

“The proposed change aims to preserve regulatory coherence and avoid overlapping of competences between the bodies responsible for the control and inspection of weapons in the country, ensuring greater legal and technical security in the application of the future standard”justified Bilynskyj.

The text also determines that professionals must have specific technical training, proven by a course recognized by the Federal Police, and that private security companies maintain individualized control of the weapons used. Inspection will continue to be carried out by the Federal Police and the Brazilian Army.

Furthermore, the proposal prohibits the use of revolvers by private security professionals on duty, regardless of caliber.

The text is processed in conclusive character and will still be analyzed by the CCJ (Constitution, Justice and Citizenship Commission). To become law, the text must be approved by the Chamber of Deputies and the Federal Senate.
