
New Anacom regulations come into force this Monday. The process must be completed by the next business day at the latest.
As of this Monday, telecommunications operators are prohibited of charge to customers through portability of the cell phone numberaccording to the National Communications Authority (Anacom).
In January, new rules for the process that allows you to keep your mobile phone number when changing operator were published in . Anacom’s new regulations come into force today, Monday.
Speaking to Lusa, an official Anacom source explained, at the time, that the changes aim to “strengthen consumer protection“.
Among these measures is the prohibition of companies charging direct portability charges to end users holding contracts associated with the numbers.
The introduction of new compensation to customers for non-compliance with the scheduling of “physical intervention on the network”, which requires it to be rescheduled for another day, was another of the points highlighted by the regulator.
The value of this compensation was set at 10 euros in the new regulation, but Anacom warned that this compensation will only be paid by the provider, that is, the new contracted operator, “when the non-compliance is not due to reasons attributable to the end user”.
Among the main changes is also the obligation of the receiving provider (PR) to ensure that portability and subsequent activation of numbers occur on the date expressly agreed with the customer “in the shortest possible time and up to one business day from that date”.
If portability and activation are completed one business day later, the consumer is entitled to a automatic compensation – calculated based on days of delay.
Furthermore, “in the event of termination of the contract, and unless this right is waived at the time of deactivation of the service, the end user retains the right to port PNN numbers [Plano Nacional de Numeração] to another company,” he added.
Other changes introduced to the portability regulation that do not result from the entry into force of the LCE are aimed at companies in the sector, namely the limitation of the wholesale cost that operators can pass on to competitors for the service. Now, it has a maximum value of one euro.
