Lula was the victim of theft with abuse of trust, says Lindbergh

The PT leader in the Chamber of Deputies, (RJ), said that the president (PT) was a victim of “theft with abuse of trust” in the case of . The expression is provided for in article 155 of the Penal Code and refers to a theft committed by someone the victim trusted and who betrays that trust to commit the crime.

“Instead of strengthening the Brazilian State, the rapporteur created a real risk to national sovereignty and transformed the fight against crime into an electoral and diplomatic weapon, a true political theft, committed under the cloak of trust”he declared.

DERRITE WANTS HARDER PENALTIES

Derrite’s report, presented on Friday (7.nov), punishments for members of criminal factions, militias and paramilitary groups. Penalties range from 20 to 40 years in prison, and can exceed 60 years in cases with aggravating circumstances, such as being a faction leader or using restricted weapons.

The text also creates new criminal types, such as armed territorial domination, sabotage of public services, attacks on financial institutions, prisons and security forces, in addition to actions known as “new bandit”.

These behaviors will be dealt with through “functional equivalence” to the Anti-Terrorism Law () – that is, factions are not classified as terrorist organizations, but are subject to the same penalties and legal effects when there is collective intimidation, threat to public peace, sabotage of essential services or challenge to State authority.

The opinion also toughens criminal execution. Regime progression may occur after serving up to 85% of the sentence, and faction leaders must serve their sentence in maximum security federal prisons.

The text also creates the National Integrated System for Combating Organized Crime and a permanent National Task Force, under the coordination of the Ministry of Justice and Public Security, to integrate security actions between the Union, States and municipalities. It also establishes punishments for companies and financial institutions that finance factions and restrictions on communication and visits to leaders imprisoned in federal prisons.
