After criticism, Hugo Motta and Gleisi meet to try to reach an agreement on PL Antifaction






The president of the Chamber, Hugo Motta (Republicanos-PB), and the Minister of Institutional Relations, Gleisi Hoffmann, are expected to meet this Tuesday to try to reach an agreement on the anti-faction bill, which is authored by the government, but is under the rapporteurship of deputy Guilherme Derrite (PP-SP), from the opposition. Gleisi and other members of the Executive Branch have expressed criticism of Derrite’s report and want the text not to be voted on as it is.

Among the sections that cause concern are the changes in the Anti-Terrorism Law, in opening up space for the Federal Police to lose influence in the fight against factions, in a section that could pave the way for criminalizing social movements and another that limits asset confiscation measures.

From these excerpts, Derrite made adjustments regarding the confiscation of assets and the PF. Still, the changes made in relation to PF did not please the corporation to the point that an agreement was reached.

The PP deputy took temporary leave from his position as Security Secretary under Tarcísio de Freitas (Republicans) in São Paulo to provide the opinion.

Even without a sign of agreement yet, Motta says he intends to take the project to a vote this week.

“The idea is to vote yes, let’s wait for the movements around the text that the rapporteur is responsible for. When I say, vote yes, it’s this week”, Motta told GLOBO.

In addition to the meeting with Gleisi, the president of the Chamber will participate this Tuesday morning in a meeting of party leaders to align this week’s voting forecast.

It is also expected that the Minister of Justice and Public Security, Ricardo Lewandowski, responsible for presenting the PL now reported by Derrite, will participate in conversations with Motta and the rapporteur.

“I have already expressed dissatisfaction on several occasions because taking the project, which is authored by the Executive Branch, and placing it with Derrite, who is Tarcísio’s Secretary of Security, who could be a candidate against President Lula, I think is disrespectful”, said the leader of the PT in the Chamber, Lindbergh Farias (RJ).

The PL Antifaction rapporteur does not classify the factions as terrorists, but gives them the same criminal treatment.

Despite this, the government points out that Derrite changed the Anti-Terrorism Law to make the comparison and is against his report, as it considers that it leaves room for organizations to be considered terrorists, which would facilitate foreign interventions.

“What is the basis for this? There is no basis at all, no international treaty talks about this, the UN charter itself does not provide this support. This discussion is moving more towards the political and not technical field”, he told GLOBO.

This Monday, Motta, Derrite and the director general of the Federal Police, Andrei Passos Rodrigues, met to debate the text. The PF is against Derrite’s report and wants to postpone the vote so that the text can be changed.

Gleisi also criticized Derrite’s opinion and complained about the possibility of reducing the PF’s powers.

“There is and will not be an agreement that suppresses the powers, duties and autonomy of the Federal Police. We view with concern any maneuver to modify the role of the PF in combating organized crime,” he said on social media.

Despite this, Derrite minimized the complaints and declared that he will not make adjustments to the distribution of competencies:

“The text preserves the role of the Federal Court, the Federal Police and in the new criminal types it also preserves the states. The competence of public ministries and state civil police in crimes equated to terrorism is expressly foreseen. Now, if the individual committed a crime of terrorism due to xenophobia, ethnicity, race, religion or color, the processing and trial is in the Federal Court.”
