of the project in the São Paulo Military Police battalions, state deputy Altair Moraes (Republicans) returned the text without a vote to a committee of the (Legislative Assembly of the State of São Paulo) as he understood that it invades the Executive’s competence.
The text was filed by the state deputy (PT), on September 15, 2023. Moraes was appointed rapporteur for the project at the Alesp Constitution, Justice and Writing Committee on October 11, less than a month later.
The proposal determines that half of the number of Military Police battalions will be completed within two years. The proportion should rise to 75% in three years and 100% in four years. When it was presented by the PT member, the initiative sought to respond to the actions made by the governor (Republicanos-SP) in the body camera program.
In October of this year, when questioned by the Panel about the , Moraes argued that the project was in the legal study phase by the commission to evaluate initiative defects. He returned the proposal to the commission this Monday (10).
This Tuesday (11), when asked why he returned the text without a vote, the parliamentarian said that, after technical analysis by the legal department, it was found that the proposal presented initiative defects, “as it deals with topics that fall within the exclusive competence of the Executive Branch, such as the organization and functioning of the Military Police, the creation of administrative obligations and the forecast of budgetary expenses.”
“Thus, the deputy chose to return the project without an opinion, preventing the matter from being closed in the Constitution and Justice Committee”, he stated, in a note. “The objective is to preserve the discussion of the topic and allow another parliamentarian to present a substitute, in order to make the processing of the proposal legally viable, given the relevance of the merit for the public security of the State.”
President of the Constitution, Justice and Writing committee, deputy Thiago Auricchio (PL) stated that he will act quickly to appoint a new rapporteur, “ensuring that the proposal resumes its processing as soon as possible”. “We hope that the debate will move forward in the thematic committees and that the House will build a balanced understanding, capable of meeting the desires of the entire society,” he said.
