At the end of this stage, the STF must publish the ruling that consolidates the result of the trial and decisions on appeals. From this publication onwards, defenses will still be able to present a final type of appeal — which is usually rejected — within a period of five days.
The Court’s jurisprudence has a firm position that successive appeals with similar arguments are merely delaying and should not interrupt the execution of the sentence of those convicted.
If there is this new challenge, a second virtual trial will be scheduled. Only after this phase, and if the ministers again deny the requests, can the process be declared final and unappealable by the rapporteur.
From that moment on, Moraes will be able to determine the beginning of the sentence. According to the former president’s allies, it is considered likely that Bolsonaro will start in the closed regime, even though his defense expects a quick migration to the home regime.
In addition to being 70 years old, Bolsonaro has health problems resulting from the stab wound he suffered in 2018, a condition that could influence the definition of the initial regime.
