Next stages
After the end of the session, the STF must publish the ruling, a document that gathers the votes of the ministers and formalizes the result of the initial trial, which generated the conviction, and the appeals.
After this, the Supreme Court has adopted the jurisprudence that the defense can present one more appeal, which must also be made five days after the publication of the new ruling.
If this type of appeal is presented, a second virtual trial must be scheduled for the ministers to analyze the new allegations. Only after this analysis, and if there is a denial, can the process be declared final and unappealable.
It is worth noting that the rapporteur, Alexandre de Moraes, is responsible for declaring the case as final and also determining whether the sentence will be served.
Moraes has several options to determine whether Bolsonaro will serve his sentence. Among them is the maintenance of the home regime and the closed regime in the Papuda Complex.
As already shown by CNN Brazil, but are betting on a short stay in prison.
According to them, Bolsonaro’s situation should be similar to that of former president Fernando Collor de Mello, who was arrested by the STF on April 24 of this year.
On that occasion, Collor began serving his sentence in an individual cell in a special wing of the Baldomero Cavalcanti de Oliveira Prison, in Maceió (AL), the following day. A week later, on May 1st, he managed to go home.
Bolsonaro, in addition to being 70 years old, has health problems as a result of the stab wound he received during the 2018 electoral campaign, when he was elected president of the Republic.
