App transport companies Uber and 99 announced this Tuesday (18) that they will start the motoapp service in the city of December 11, even though the City Hall does not regulate the mode. THE Estadão questioned the municipal management about the deadline, but has not received any response so far. Last week, the Federal Supreme Court () rendered unconstitutional the São Paulo law that gave municipalities autonomy to allow or veto the paid individual transport of passengers by motorcycles, whether in the form of a motorcycle taxi or through apps.
The mayor (MDB) has been a strong opponent of the model, on the grounds that transporting passengers by motorcycle increases the number of traffic accidents. The sector counters this criticism and says it adopts safety protocols. When the applications started offering the service despite City Hall’s prohibition decree, he called the companies irresponsible.
The São Paulo Court of Justice had already given the deadline of December 8th for City Hall to regulate motorcycle taxis and motoapps. This Tuesday, in an announcement to the press, the Uber and 99 suggested a regulatory proposal. The measure includes the requirement that the driver be at least 21 years old and periodic in-person training. The companies claim that they will implement these standards from the beginning of operations, even if municipal management does not make these demands.
See the measures that will be adopted by companies:
– Data sharing and traffic intelligence – Transfer of aggregated and anonymized information from each company to the public sector for mobility planning, road engineering, accident reduction and traffic education campaigns, transferring intelligence and data to authorities, in compliance with data protection law;
– Driver certification – Requirement that motorcyclists must be at least 21 years old, above the legal limit, in addition to having a driving license with EAR (Performs Remunerated Activity);
– Security training – Continuous training actions in defensive driving and good practices for motorcyclists, in addition to periodic in-person training, in partnership with recognized institutions;
– Equipment distribution – Donation of reflective vests, according to the companies, “for the most engaged drivers”;
– Monitoring and valuation – Use of technology to detect risk patterns (such as speed and sudden braking) based on telemetry to implement alerts, feedback, educational content and restriction policies. There will also be incentives to recognize and reward drivers who adopt safe practices;
The mayor of São Paulo, Ricardo Nunes (MDB), has been trying to stop passenger transport by motorcycle since 2023, when companies first offered the service in the capital. Last week, Nunes criticized the STF’s decision. “I have no alternative but to express my concern about the foolishness of the STF on a topic that deals with people’s lives. With all due respect to Minister Alexandre (, rapporteur of the case at the Supreme Court), you just need to read a little more in detail, because the federal law delegated to the municipalities (the power to allow or veto motorcycle taxis), there is no invasion of jurisdiction.”
