The Army commander, Tomás Paiva, asked the minister of the (Supreme Federal Court) that the members of the corporation convicted of the coup plot be led by military personnel and not be handcuffed at the time of arrest.
The two spoke on Monday (17) at the Army general’s residence, in the Urban Military Sector of Brasília. The Minister of Defense, also participated in the meeting.
When contacted by the report through the court’s office and press office regarding the Army commander’s requests, the minister did not comment. The information about Tomás’ request to Moraes was initially published by UOL and confirmed by Sheet.
Among the military personnel already convicted by the First Panel of the STF in the coup plot are the former Army commander and former Defense Minister, General Paulo Sérgio, and the former Minister Augusto Heleno, who commanded the GSI (Institutional Security Office) during the former president’s administration ().
For both of them, the eventual arrest must follow protocols similar to the detention of General Walter Braga Netto, with separation from a General Staff room. The most likely location is the Planalto Military Command, in the center of Brasília.
Braga Netto, in turn, has been imprisoned since last year in a military unit in Rio de Janeiro, where he must remain after Moraes orders the execution of his sentence to begin.
Military personnel may still lose the right to imprisonment in a military unit if their posts and patents are revoked by the STM (Superior Military Court). In this scenario, they are considered unworthy of officialdom and lose the typical benefits of the career.
This Tuesday (18), the STF published in the DJe (Electronic Justice Gazette) the ruling that rejected the first appeals of Bolsonaro and the other defendants from the central core of the coup plot, which includes Paulo Sérgio and Augusto Heleno.
The official publication of the document so that the defenses of those convicted can present new appeals in the process.
Bolsonaro and other defendants will only be arrested when they can no longer present appeals. Normally, the STF has determined the execution of the sentence after rejecting the second embargoes. Moraes can order immediate arrest if he understands that the defenses filed appeals just to delay the execution of the sentence.
