PGR rejects Mauro Cid’s request to end sentence for coup d’état

The Attorney General’s Office took a stand against Lieutenant Colonel Mauro Cid’s request to extinguish his , imposed in the process that investigates his participation in the attempted coup d’état after the 2022 elections.

Cid argued to the Federal Supreme Court that the period in which he was detained preventively, which totals five months and 21 days, and the almost two years he was subjected to precautionary measures, such as an electronic ankle monitor, should be deducted from the total sentence. According to the defense, the reduction would immediately end the punishment.

The Attorney General of the Republic, Paulo Gonet, disagreed. In a statement sent to the STF, he stated that criminal detention is only possible when there is “effective restriction of freedom of movement”, which does not apply to precautionary measures.

For the PGR, only the period of preventive detention can be discounted, which indicates that it is insufficient time to extinguish the conviction.

Gonet highlighted that Cid was imprisoned between May 3 and September 9, 2023 and again between March 22 and May 3, 2024, a total that does not reach the two years of the sentence defined by the Supreme Court. “There is no hypothesis of extinction of punishment”, he wrote.

The decision will now be made by Minister Alexandre de Moraes, rapporteur of the actions involving the coup plot. If Moraes follows the PGR’s opinion, Cid will need to serve just over a year and a half in an open regime, with rules such as nighttime home confinement, prohibition on leaving the region, cancellation of passport, blocking of use of social networks and weekly court appearances.

Convicted in the operational core of the coup attempt, Cid received the mildest punishment among the soldiers involved for having signed a plea bargain agreement.

At the same time, the Federal Police recommended to the Supreme Court the. The PGR defended that the defense be consulted to inform whether there is interest in the measure.
