The rapporteur’s new opinion establishes automatic loss of assets during investigation if investigation does not prove lawful origin

The president of the Chamber of Deputies, (Republicanos-PB), defended this Tuesday (18.Nov.2025) the new version of the opinion of the rapporteur of the PL (Bill of Law) Anti-Faction (5,582 of 2025), Guilherme Derrite (PP-SP), earlier this afternoon. Motta stated that he recognizes the “the work of the Minister of Justice, the government leaders, but the work of the legislature and the Chamber of Deputies is to improve the proposal”.

The new report establishes that seized assets may be automatically lost during the police investigation, if the person being investigated is unable to prove that the origin of these assets is lawful and if there is a risk that these assets will be hidden or dissipated. The Chamber is expected to vote on the text this Tuesday (Nov 18).
