The leader of the PT in the Chamber, Lindbergh Farias, stated that he had filed two measures against the deputy this Thursday — a petition to the STF, in which he also requests the preventive detention of Ramagem, with a report on the escape to the USA, and a request for clarifications to the Board of Directors of the Chamber.
“What is at stake is the authority of the institutions. A parliamentarian convicted of serious crimes against democracy cannot flee to Miami as if nothing had happened,” he wrote on X (formerly Twitter).
Last week, Ramagem, the former president (PL) and others convicted of the coup plot had appeals denied and are approaching the moment of execution of the sentence — experts cite the possibility of it occurring from next week.
PSOL’s request says that the “Federal Constitution and the Brazilian legal system allow the decree of precautionary arrest (as preventive) when the legal requirements are present: risk to public order, criminal investigation, guarantee of the application of criminal law, convenience of the accusation or defense”.
“In the case at hand, residence or stay abroad, as reported, can constitute a real risk of flight, justifying the decree of precautionary arrest. Furthermore, the seriousness of the crimes charged (attempted coup, criminal organization) reinforces the need for caution and urgent judicial intervention to guarantee the application of the law”, says the text.
Ramagem was sentenced to 16 years, one month and 15 days in prison, initially under a closed regime.
The Supreme Court also ordered the loss of his federal deputy mandate. This decision, in theory, would still need to undergo a Chamber analysis after the end of the possibility of appeals in the trial.
According to experts consulted by the report, however, Ramagem would already be arrested after the appeals ended.
“If he were in Brazil, not only him would be arrested, but everyone who had a final and unappealable conviction and in a closed or semi-open regime”, says criminalist Daniel Bialski, master in criminal law from PUC-SP.
“If the arrest warrant comes out and he is outside Brazil, the Brazilian government can issue a red broadcast, which is a warning to countries that have relations with us, saying that he has an open arrest warrant. Depending on the country he is in, extradition may be requested.”
A possible escape from Ramagem adds to other recent cases of deputies who went abroad amid investigations and actions by the Supreme Court.
In July, (Podemos-ES) contradicted Moraes’ decision that his passport be seized. He is being investigated for having campaigned on social media against federal police officers who were investigating the coup plot.
Upon returning to Brazil, the minister ordered him to wear an electronic ankle bracelet, which caused friction between the Supreme Court and Congress. Moraes just let him remove the equipment.
The deputy (PL-SP) fled the country in June to escape the ten-year prison sentence for the invasion of the CNJ (National Council of Justice) system and the issuance of a false arrest warrant against Moraes. She was arrested in Rome and Brazil.
