The deputy (União Brasil-SP) filed a criminal report with the (Attorney General’s Office) against the Union’s attorney general, to determine whether he failed to adopt measures against entities accused of involvement in the scheme.
Messiah went to the vacancy left by the (Federal Supreme Court).
In the request, Kataguiri asks that appropriate actions be taken so that Messias is removed from his duties until the investigation and criminal action are concluded.
The request is based on a report from the newspaper O Estado de S. Paulo that cites internal AGU documents from 2024 that would show an increase in legal complaints about unauthorized discounts. Among the entities mentioned is the (National Union of Retirees, Pensioners and Senior Citizens of Força Sindical), whose vice-president is the brother of the president (PT).
The report states that, when requesting judicial blocking of suspicious entities, in May 2025, the AGU left out six of the nine entities that appear in the body’s survey.
In the criminal report, Kataguiri states that, despite having full knowledge of all the irregularities, having access to the elements produced by his own internal affairs department, being aware of the express determinations of the TCU and the progress of the Federal Police investigations, the minister failed to adopt comprehensive administrative and judicial measures.
Messias, says the parliamentarian, opted for “selective measures that precisely omitted entities considered central to the scheme, at the same time that he acted institutionally to weaken the execution of the control body’s orders.”
The deputy also cites AGU’s actions with the (Federal Audit Court) as a delay, with the intention of removing or relaxing obligations imposed on the Administration, such as the full revalidation of discount authorizations within 120 days.
In a note published in response to the Estadão report, the AGU stated that the AGU’s concern at the time was with the existence of possible predatory litigation against the INSS. “Therefore, it had nothing to do with fraud against policyholders, which were only known to society on April 23 of this year”, he indicated.
