The federal deputy (PSOL-SP) filed a criminal report with the Public Ministry of the State of São Paulo against those who entered Emei (Municipal Early Childhood Education School) Antônio Bento, in the west zone, and.
The episode occurred after a collective activity about the book “”, which represents the mythology of the orixás in , in which the children needed to draw one of the orixás portrayed in the book. The father of one of them, a police sergeant, got angry and demanded explanations from the class teacher and the director. The following day, other police officers returned to the scene and questioned the professionals about the case.
In the criminal report, the deputy states that the acts constitute religious racism, abuse of authority, illegal embarrassment, damage to public property and outrage against Afro-Brazilian cult or cultural practice.
In the document, Ivan Valente states that the set of incidents makes it clear that “the armed and overt presence of military police officers inside a preschool, without legal support, without real urgency and motivated by a complaint incompatible with the network’s official curriculum, produced a scenario of intimidation, abuse and embarrassment against public servants, families and children.”
It also argues that police action, in addition to potentially violating criminal and administrative norms, “infringed fundamental rights related to pedagogical freedom, child protection, racial equality and religious freedom, especially because it went against educational activity supported by federal legislation”.
The parliamentarian requests images from the internal and external cameras of the municipal school and the body cameras of the military police officers involved. It also requests that the director be heard, that the agents be identified and that the files be sent to the Military Police Internal Affairs Office to determine the administrative disciplinary responsibility of the police officers.
The deputy also mentions the investigation of civil responsibilities to repair collective and institutional moral damages and that the responsibility of the student’s father for the damage caused to the school’s public property and possible participation in the triggering of the other illicit acts narrated is verified.
