To reach the STF, Messias still goes through the CCJ and plenary; see the rite

The announcement of the name of the Advocate General of the Union, Jorge Messiasto fill a vacancy in the STF (Supreme Federal Court) put an end to the expectations surrounding the choice of Luís Roberto Barroso’s replacement in the Court. The choice, however, still has a long way to go in the Federal Senate.

“I make this indication in the certainty that Messias will continue to fulfill his role in defending the Constitution and the Democratic Rule of Law in the STF, as he has done throughout his public life”, he communicated.

The first step has already been completed. Lula communicated the decision to the Senate by publishing an extra edition of the DOU (Official Gazette of the Union) and the message then went to the desk of the president of the Senate, Davi Alcolumbre (União-AP).

Government officials have already entered the field to try to “soften” tempers and prevent Alcolumbre from blocking the nomination, as referral to the CCJ (Constitution and Justice Commission) depends on him. The president of the Senate defended the nomination of Rodrigo Pacheco (PSD-MG) for the vacancy.

In the case of André Mendonça, nominated to the STF by Jair Bolsonaro (PL) in 2021, Alcolumbre held the nomination for four months. At the time, Alcolumbre was president of the CCJ, which is responsible for hearing and voting on the nomination.

With the referral to the commission, it is up to the president of the collegiate Otto Alencar (PSD-BA) to schedule the hearing. At this stage, Messias is expected to tour the parliamentarians’ offices, which is known as “kissing hands”.

It is up to the CCJ to examine and vote on the nomination, so that the nomination can then be considered by the House plenary.
