The defense of () asked the (Supreme Federal Court) this Friday (21) that the former president be kept under house arrest, on the eve of the end of the coup plot process in court.
In the petition, made to the minister, rapporteur of the case, the lawyers list Bolsonaro’s health problems and speak of a “risk to life”. They ask that the former president be kept at home, where he has been under house arrest since August 4th.
“What is certain is that the change to the house arrest already served by the petitioner will have serious consequences and pose a risk to his life”, says an excerpt from the petition. A medical report and exams were attached to the request made to the STF.
The deadline for the declaration embargo, appeal against conviction of 27 years and three months in prison, ends next Monday (23). And the closed regime in a prison could be decreed from then on.
Today Bolsonaro’s biggest fear is being in the Federal District. This thesis gained strength after Moraes was sent to prison.
Another possibility would be for Bolsonaro to go to a room in the Federal Police superintendence, as happened with (PT) in Curitiba. The hypothesis of him being transferred to a military installation is now considered the least likely, despite him being a captain.
In the request made to the Court, the lawyers say that Bolsonaro’s health, who suffers from hiccups, is “profoundly weakened” and mention that the former president has been to the hospital three times since his house arrest was ordered.
They say that the former president has serious illnesses of multiple natures: cardiological, pulmonary, gastrointestinal, neurological and oncological. Therefore, it needs monitoring at all times, something that the prison system could not provide, they say.
Bolsonaro’s health is his allies’ main argument for defending that he remains at home, despite his conviction for leading the coup plot. His interlocutors mention shortness of breath, hiccups and indigestion.
Their allegation, also used by lawyers, is that the former president will not be able to receive adequate medical care in prison and, therefore, could die.
“The petitioner’s medical situation was detailed by the doctors currently responsible for the treatments he underwent and demonstrated by the various medical examinations he has undergone (doc. 01). And they show that a serious or sudden illness is not a question of ‘if’, but of ‘when'”, says another excerpt of the petition.
The former president’s lawyers use as a precedent the case of former president Fernando Collor, who was authorized to serve house arrest this year by Moraes, also for health reasons.
The medical report does not suggest that he be kept at home, but provides a history of the former president’s health and says that “the recurrence of such conditions will necessarily require care in a hospital environment.”
General surgeon Claudio Birolini and cardiologist Leandro Echenique bring a list of 10 ICDs (International Code of Diseases), ranging from anemia and hiccups to sleep apineia.
In an interview with Sheet At the end of March, Bolsonaro said that prison would mean the end of his life. At the time, he was still free, active in the party, traveling around the country. His argument involved the fact that he was 70 years old and that the accusation had crimes that carried decades of punishment.
Now, he faces prison in Brasília, to serve his sentence for 27 years and three months for leading the 2022 coup plot.
This month, which highlighted overcrowding and poor conditions for the elderly in . The report was cited by Bolsonaro’s defense in this Friday’s petition.
Defenders registered 340 people for 177 spaces in the elderly wing — 92% trapped beyond capacity. Elderly people over 80 years old were found sleeping on mattresses on the floor.
Bolsonaro is 70 years old and, if he were an ordinary prisoner, he could be sent to the wing inspected by the defenders. But this hypothesis is not on the STF’s list of possibilities today.
Doctors went to the former president’s house last Saturday (15) to begin evaluating him. In the last week, his hiccups have worsened, according to people who were with him.
One of the reports reports hiccups, which require an increase in the dose of medication, to avoid bronchoaspiration of vomit. With medication, Bolsonaro becomes drowsy and sleeps for many hours, even missing meals.
The former president had shown an improvement in his health in the last month, even doing physical exercises at home. But the proximity to the end of the process at the STF coincided with a worsening of his illnesses. Allies say that the emotional factor also plays a role in this situation.
