Dino accompanies Moraes and votes to keep Bolsonaro in prison

Minister states that there is a “concrete risk of evasion”, violation of precautionary measures and threat to public order

Minister Flávio Dino, of the STF (Supreme Federal Court), voted this Monday (24.Nov.2025) to maintain the preventive detention of the former president (PL). He spoke in the referendum on the decision that converted house arrest into preventative on Saturday (22.nov).

In the vote, Dino stated that all legal requirements for preventive detention are present, including non-compliance with a precautionary measure, risk of evasion and threat to public order. Read (PDF – 195 kB).

Dino cited the episode recorded at 00:08 on Saturday (Nov 22), when the monitoring equipment was damaged. For him, the evidence is unequivocal: “Widely publicized video constitutes incontrovertible evidence regarding the attempt to destroy the equipment guaranteeing the precautionary measure”. According to the minister, the act demonstrates “flagrant violation” of the rules imposed by the STF and increases the risk of escape.
