Allies of () have drawn a parallel with the arrest of the president (PT) in Lava Jato by expressing their expectation that the minister, of the (Supreme Federal Court), will keep the former president in the Federal Police Superintendency in Brasília.
Lula was also imprisoned in a PF superintendency, but in Curitiba, for 580 days. He was released in 2019. Allies of the former president, when commenting on the situation, quote the PT member and assess that Moraes may opt for equivalence of treatment in his decision. They say that, if he orders Bolsonaro to go to prison, public opinion could turn in their favor.
The main fear is a decision to serve a sentence in a closed regime in Papuda, which is possible, as Moraes’ chief of staff recently visited the facilities there. But there is unanimity among the former president to say that the magistrate’s decision is unpredictable.
Both the defense, parliamentarians and allies have intensified the argument that the former president’s health condition is deteriorating to demand his return to house arrest. Last Friday, before pre-trial detention, lawyers claimed there was a risk to his life if he left the house.
Furthermore, they consider that sending to a military establishment would be the second best scenario, but this is considered unlikely even by them. Therefore, they began to hope that he would remain in the superintendency.
This type of establishment at the PF is called a General Staff room, there is no interaction with other inmates and there is greater comfort than in a prison. Bolsonaro’s cell is a 12 m² room, with a television, air conditioning, private bathroom and a desk.
The installation is still provisional. Initially, there was no medical care available, which was later determined by Moraes. Bolsonaro’s doctors are also concerned about the lack of space for physical exercise, which could be a demand from the defense, in a second moment.
The food is also being prepared by former first lady Michelle Bolsonaro and delivered by assistants daily, according to the rules established by the PF itself, in a transparent container.
Moraes allowed the visit without the need for prior authorization from his lawyers and doctors. Furthermore, the former president was with Michelle for half an hour on Sunday (23), and will be with his sons Flávio Bolsonaro (PL-RJ) and Jair Renan (PL) this Tuesday (25).
Bolsonaro’s brother-in-law and pre-candidate for federal deputy, Eduardo Torres also went to take personal items and medicines to the former president. This Monday, he arrived at the building with a thermal bag.
Bolsonaro was preventively arrested this Saturday morning (22), in Brasília, at the STF. In a video and report released by the Federal District Penitentiary Administration Secretariat, Bolsonaro himself confessed to having tried to open the electronic ankle bracelet.
The former president had been under house arrest since August 4 and was taken by the PF on the grounds of ensuring public order in the face of an attempt to violate an ankle bracelet and because of a summons by Flávio.
Members of the STF state that a decision on definitive arrest could be given as early as Tuesday (25), if Moraes maintains the understanding that a second presentation of appeals would only be a delay and would not have the capacity to change the outcome of the trial.
Moraes could deny these appeals individually, determine the start of serving the sentence and send the case for confirmation to the First Panel of the STF. This expectation also takes into account the history of decisions taken by Moraes, the instruments available to the former president’s lawyers and the paths that ministers can take.
The projection, as lawyers consider in the case and the jurisprudence pacified in the court on the appropriateness of the so-called embargoes for declaration and infringing embargoes.
