Braga Netto’s defense asks the STF to review the sentence

Former minister of the Civil House was sentenced to 26 years and has been in preventive prison since December 2024

The defense of the general, former Minister of the Civil House, asked the STF (Supreme Federal Court) on Monday (Nov 24, 2025) to review the sentence of 26 years and 6 months in prison for his involvement in the attempted coup d’état in 2022. The lawyers chose to file motions for declaration and infringement motions.

The since December 14, 2024 on charges of obstructing the investigation into the attempted coup d’état in the country to prevent the inauguration of the president (PT). During the investigations, the PF (Federal Police) identified that the general tried to obtain confidential data from Mauro Cid, former aide-de-camp of (PL).

In the infringing embargoes, Braga Netto’s defense spoke of “absolute incompetence” of the 1st Panel of the STF to judge the case and the restriction of defense due to “document dump” (massive and disorganized volume of evidence).

The appeal seeks the nullity of the process or the acquittal of the general based on several excerpts from the .

It will now be up to Minister Alexandre de Moraes to analyze the admissibility of the appeal. If he understands that the allegations are valid, he will submit and request a new trial in the 1st Panel. If he understands that the appeal should not be admitted, the minister may deny the embargoes and order the case to become final and unappealable.

After the case becomes final, Moraes will be able to determine the sentence for those convicted.
