The First Panel of the STF (Supreme Federal Court) unanimously confirmed this Tuesday (25), the decisions of Minister Alexandre de Moraes that determined the immediate beginning of the execution of the sentences.
Moraes made official this Tuesday (25) the definitive sentence of (PL) to 27 years and 3 months in prison.
The rapporteur asked the president of the First Panel, Flávio Dino, to schedule sessions in the court’s virtual plenary — a remote environment through which ministers cast their votes and there is no space for debate.
Dino scheduled the start of the referendum trial of Moraes’ decisions for 6 pm. He was also the first to vote, accompanying the rapporteur. In addition to him, Cristiano Zanin and Cármen Lúcia voted in the same way.
Moraes also ordered the arrest of those convicted of those who were still free. Former ministers Augusto Heleno, Anderson Torres and Admiral Almir Garnier, defendants in the same action, began serving the sentence to which they were sentenced in the same action.
The decisions are the outcome of a process lasting at least eight months against the former president — he was declared guilty this year on September 11th.
The former president will be detained in the same place where he has been detained since the 22nd: the Federal Police Superintendency of the Federal District.
The final judgment is the end of the process and from when the sentence begins to be effectively served. Until now, Bolsonaro was complying with precautionary measures and since the end of the week in pre-trial detention.
“Due to the fact that the defense allowed the period for new motions for clarification to elapse without any manifestation, as certified by the Judiciary Secretariat, as well as because there is no legal provision for any other appeal […] I declare the criminal action final, regardless of the publication of the ruling”, said Moraes in his decision on Bolsonaro.
According to him, it is not appropriate to present infringing embargoes, which could review the former president’s conviction, because there was no minimum number of two votes for Bolsonaro’s acquittal.
In Moraes’ decisions, he defined the place of arrest of the other defendants in the main group of the coup plot. Former minister Braga Netto, candidate for vice-president in the 2022 elections, for example, must remain imprisoned in the 1st Army Division in Rio de Janeiro.
This Monday (24), Moraes unanimously determined Bolsonaro’s preventive arrest.
On the same day, the deadline for the defenses of those convicted of the so-called central nucleus of the coup plot to present the seconds, which allow clarification of points of the decision regarding the coup plot, was closed.
Among the defendants of the so-called central nucleus of the coup plot, the defenses of former ministers Walter Braga Netto, Augusto Heleno and Paulo Sérgio Nogueira and Almir Garnier presented appeals.
The defense of Anderson Torres, former Minister of Justice, only asked that he be imprisoned at the Federal Police Superintendence in the DF or at the Operational Aviation Battalion.
The federal deputy (-RJ) left Brazil and went to the United States. Last Friday (21), Moraes decreed the arrest of the parliamentarian as a precautionary measure to avoid risk to law enforcement.
