STM should judge loss of rank of Bolsonaro and other convicted military personnel

The process must begin after the final and unappealable decision of the convictions and arrests of those accused of the coup plot

According to the Constitution, an Armed Forces officer can be expelled from the forces in the case of a criminal conviction.

The minister, of the Federal Supreme Court (), determined this Tuesday (25) that the Military Justice and the Military Public Ministry (MPM) be informed about the execution of the convictions of the former president and other Armed Forces soldiers in the criminal action of the coup plot. With the declaration of final and unappealable convictions and the arrests of the accused, the former president, who is a captain in the Army reserve, the generals, , and the admiral will be subject to an action to lose their official status and will be judged by the Superior Military Court ().

“Inform the presidency of the Superior Military Court and the Attorney General of the Military Public Ministry, in accordance with article 142, paragraph 3, VI and VII, to decide on the loss of the post and patent of Jair Messias Bolsonaro”, dispatched the minister.

According to the Constitution, an Armed Forces officer can be expelled from the forces in the case of a criminal conviction exceeding two years’ imprisonment for a criminal conviction. There is no deadline for the Military Public Ministry to request the loss of patents from the STM.
