In final arguments to the STF, PL deputies deny deviations from amendments

The federal deputy Josimar Maranhãozinho (PL-MA) and the substitute parliamentarian Bosco Costa (PL-SE), defendants accused of deviation from amendments, denied the crimes in final arguments sent to the STF (Supreme Federal Court) this Wednesday (26).

According to the indictment, between January and August 2020, the parliamentarians were part of a criminal organization and practiced passive corruption by requesting R$1.67 million in bribes from the then mayor of São José do Ribamar (MA). In exchange, they would have allocated R$6.67 million in health amendments to the municipality.

The defense of deputy João Bosco da Costa asked the Supreme Court not to consider the evidence collected during Operation Ágio Final, by the PF (Federal Police), as it was illegal. In addition to the acquittal of the parliamentarian for the crimes charged.

According to the defense, the request for conviction must be unfounded due to “the uncontroversial absence of misappropriation of resources, or because he was only attributed with receiving R$75,000.00”.

While deputy Josimar’s lawyers argued that the CGU (Comptroller General of the Union) attested that it was not possible to correlate the transfers with the parliamentarian.

“Public documents and the testimony of the then mayor of São José de Ribamar/MA demonstrate that the amounts received by this municipality were allocated by the Ministry of Health after approval of proposals formulated by the city hall. That is, the transfers did not originate from parliamentary amendments”, they justify.

Still this Wednesday, the Court should receive final arguments from deputy Pastor Gil (PL-MA).

The final arguments presentation phase is the last before the rapporteur, Minister Cristiano Zanin, releases the case for trial.
