The former president was sentenced last Tuesday to 27 years and three months in prison for leading an effort to reverse the results of the elections in 2022. As a result, Bolsonaro, who was already in pre-trial detention, also loses his political rights.

“Unfortunately, as a result of the law and due to the suspension of the political rights of our honorary president, Jair Bolsonaro, our leader’s respective party activities will also be suspended, including his remuneration, while the effects of the condemnatory ruling in AP 2668 continue [ação penal da trama golpista]”, says a note released by PL.

In 2023, when he returned to Brazil from the United States, Bolsonaro had a Do PL, receiving R$39,293, in addition to military pensions (R$11,945) and the Chamber of Deputies (R$35,223).

The former president was preventively arrested last Saturday by the PF (Federal Police), under the justification of risk of escape and threat to public order. Before that, since August, he was under house arrest.

With the definitive conviction in the case of the coup plot, Moraes also decided to keep Bolsonaro imprisoned at the Regional Superintendency of the Federal District, not sending him to prison, as his allies feared.

Lawyer Alberto Rollo, a specialist in electoral law, explains that this is a consequence of the suspension of the convicted person’s political rights.

“There will be nothing expressed [na lei] same. I understand that it is a consequence of the suspension of political rights. Anyone whose political rights are suspended cannot hold a public/party position and therefore cannot receive a salary”, he stated.

The Supreme Court’s regulations provide that these review actions will be distributed to ministers from the group that did not judge the convicted person — that is, in Bolsonaro’s case it would go to the Second Panel — and, in the event of an appeal, they will be judged by the court’s plenary session.
