O STF (Supreme Federal Court) scheduled this Wednesday (26) the judgment on the processes involving the time frame for demarcation of indigenous lands for the days December 5th to 15th.
The trial will take place in a virtual plenary session and the case was released for trial by the dean minister Gilmar Mendesrapporteur of the actions.
As already shown by CNN Brazil.
The trial in a virtual plenary session at the STF takes place with ministers recording their votes and statements in a digital environment, within a previously defined deadline. Initially, the report is presented and the rapporteur votes, and then the other ministers can vote, without a specific order.
At the trial, the ministers will analyze a proposal prepared by the Special Commission formed at the Court, after 23 hearings.
The text deals with a draft law that must pass through the plenary of the Supreme Court and be sent to the National Congress.
The time frame thesis, provided for in Law No. 14,701/2023, was considered unconstitutional by the STF in September 2023.
According to the invalidated law, indigenous peoples would only have the right to demarcate land if they were occupying these locations or if they were already disputing the areas on the date of promulgation of the 1988 Constitution.
However, after several actions were filed with the Court — against and in favor of the law and the Supreme Court’s decision — a special commission was set up to seek a consensus on the issue.
